Pending California RFID Legislation

Even as a "common sense" approach to RFID legislation is being considered by the California legislature, new legislation to put RFID "on hold" for state-issued ID cards is moving through the California legislature. The California Assembly Judiciary Committee has approved two different bills (SB 433 and SB 1078) that would put a three-year moratorium on the use of RFID for state-issued IDs. SB 433 applies to driver's licenses and SB 1078 applies to student identification cards. The California Senate previously approved both bills.

AIM is looking into the details of this legislation and will provide ongoing coverage of this legislation -- but three issues have already surfaced.

On October 3, The Boeing Company announced plans to introduce radio frequency identification (RFID) smart labels on maintenance-significant parts of the 787 Dreamliner, its newest passenger aircraft. According to the news release, "RFID technology will improve configuration control and help airlines reduce costs by managing part maintenance and repair histories."

Boeing startled some in the RFID industry by stating flatly that the smart labels they require will not be the "ordinary" ISO 18000-6C (Gen2 UHF) tags. They'll have to be metal-mountable and tested against extreme fluctuations in temperature and pressure. And they'll need 128 kilobits of user memory.

Boeing also made another startling announcement. All Boeing divisions have joined EPCglobal. For those conversant with current aerospace coding conventions, this revelation raises a lot of questions.

An independent study, commissioned by Wal-Mart and conducted by the RFID Research Center at the University of Arkansas, found a 16 percent reduction in out-of-stocks, as well as a reduction in excess inventory in RFID-enabled pilot stores.

In an industry that's hungry for good news, this seems like great news and shows a real benefit for manufacturers who are applying EPC labels. However, upon closer reading, it may be more a matter of the process changes associated with RFID that should be credited with much of the improvement.

California State Senator Joe Simitian has found a way to get his RFID bill ("Identity Information Protection Act") to the Senate floor after it was held in Appropriations. A different bill, also authored by Simitian, SB 768, which addressed marine finfish aquaculture and which had already been approved to go to the Senate floor, was completely gutted and the text replaced with his RFID legislation (SB 682). This change was approved by the Senate on 2 September 2005.

Texas Instruments (TI) on 27 June 2005 announced a delivery milestone of pre-production samples of Gen2 UHF inlays and straps to label converter and printer customers. TI will begin ramping to volume production in the millions beginning in July 2005, starting with its ultra-high frequency (UHF) EPC Gen2 inlays. Gen 2 strap manufacturing will also begin in July.
